Multi-class Trademark Application

NICE classification categorised the goods and services into different classes; you can either file a multi-class trademark application in which applicant seeks registration for more than one classes or single class trademark application to file under one class only.

The Trademark Act, 1999 provides for Classification of Goods and Services under Section 7 of the Act. According to this section, The Registrar shall classify goods and services, as far as may be, in accordance with the International classification of goods and services for the purposes of registration of trademarks. The Trademark Law allows to file a trademark application in the following ways:

  • Single-class Trademark Application is a trademark registration application to seek protection under any specified class of goods/ services.
  • Multi-class Trademark Application is an application for trademark registration in which the applicant seeks registration for more than one class. Often applications are submitted with payment for one class, although many classes are available.

Why choose single class trademark application over the multi-class trademark application?

The benefits of single class applications outweigh the benefits of filing trademark under multi-class application.

What are the different classes of goods and services to file a trademark application?

The Trademark Registry has classified the goods and services according to the 10th Edition of Nice Classification of Goods and Services. The Nice Classification administered by WIPO in 1957.
