Major Difference Between Registration and License from FSSAI

Food Safety and Standards (Licensing and Registration of Food businesses) Regulation, 2011 governs the registration/license of food businesses. The terms registration and license are often read as one, but there is a significant difference between the two, which can be studied below.

All Food Business Operators (FBOs) must get themselves registered with FSSAI by making an application for registration or license as per the nature and size of their business.

Who shall get FSSAI Registration?

FSSAI Registration is for petty food business operators. The list of Petty Food Business Operators is as follows:

  • Food businesses are manufacturers of food or sell food products. They might manufacture/sell the food products themselves, or a petty retailer/hawker/itinerant vendor/temporary stallholder, or businesses who distribute food including in any religious or social gathering. But it does not include a caterer;
  • Small scale or cottage or tiny food businesses or such other food businesses having who have an annual turnover of up to Rupees 12 lakhs; and/or
  • FBOs whose production capacity is up to 100 kg/liter per day (it excludes milk/milk products/meat and meat products); or
  • Businesses whose procurement, handling, or collection of milk is up to five hundred liters of milk per day; or 
  • Businesses whose slaughtering capacity is 50 poultry birds a day or less, or 2 large animals, or 10 small animals.

FSSAI License required by?

Food operators (individuals or entities) that are not covered under the definition of petty food business operators are required to apply for an FSSAI license to run their business operations in the country. Furthermore, FSSAI licenses are distributed in two categories i.e. State FSSAI License and Central FSSAI License. This categorization is based on the size and nature of the business.

Statutory Fees for making an application

Statutory Fees are Rs.100 per year.

Statutory Fees differ from rupees 2,000 to rupees 7,500 per annum as per the nature of the business and type of license applied for.

The procedure along with the fee structure is also different for obtaining a license and a registration. Where the process for registration is very basic and requires fewer documents, on the other hand in order to obtain a license the details and documents required are more in comparison to the registration process. It must also be noted that there is a certain variation in the requirement of documents for application of State and Central license as well.
