Trademark Classes

Trademark Classes categorize various products and services which can be registered as a Trademark. Classes 1 – 34 define products while Classes 35-45 define the services.

 

The World Intellectual Property Organization (WIPO) has specified Nice Classification (established under the Nice Agreement) which is an International System to classify goods and services.

It is important to mention the correct class of goods or services in your trademark application. You can also file multiple-class trademark application if your mark exists under many classes.

Class 1 – Chemicals

This class includes chemicals for use in industry, science, photography, agriculture, horticulture and forestry, adhesives for use in industry, compost, manures, and fertilizers.

Class 2 – Paints, Coatings and Pigments 

This class includes paints, varnishes, lacquers, raw natural resins, colorants, dyes, inks for printing, marking and engraving.

Class 3 - Cleaning Products, Bleaching & Abrasives, Cosmetics

This class includes non-medicated cosmetics, toiletry preparations, dentifrices, perfumery, essential oils, and bleaching preparations.

Class 4 - Fuels, Industrial Oils and Greases, Illuminates

This class includes industrial oils, greases, wax, fuels and illuminants, candles and wicks for lighting.

For example – Castrol by Castrol Limited.

Class 5 – Pharmaceutical

This class includes pharmaceuticals, medical and veterinary preparations, material for stopping teeth, dental wax, disinfectants, plasters.

For example – Mankind by Mankind Pharma Limited. 

Class 6 – Metals and Hardware

This class includes common metals and their alloys, ores, non-electric cables and wires of common metal, safes.

For example – TATA Steel Steel with Soul by Tata Steel.

Class 7 – Machines, Tools & Parts

This class includes automatic vending machines, machines and tools, motors and engines, transmission components.

For example – Toshiba by Kanushiki Kaisha Toshiba Toshiba Corporation.

Class 8 - Hand Tools, Cutlery, Razors

This class includes Hand tools and implements, hand-operated; cutlery; side arms, except firearms; razors.

For example – Gillette by The Gillette Company

Class 9 - Computers, Software

This class includes DVDs and other digital recording media, computer software, fire-extinguishing apparatus, apparatus for recording, transmission or reproduction.

For example – Dell by Dell Inc.

Class 10 - Medical, Dental Instruments and Apparatus

This class includes surgical, medical, dental and veterinary apparatus, instruments, artificial limbs, eyes and teeth, suture materials.

For example – Baxter by Baxter Travenol Laboratories Inc.

Class 11 - Appliances, Sanitary Installations

This class includes apparatus for lighting, heating, steam generating, cooking, refrigerating, drying, ventilating.

For example – Parryware by Roca Bathroom Products Private Limited

Class 12 – Vehicles

This class includes vehicles; apparatus for locomotion by land, air or water

For example – Honda by Honda Giken Kogyo Kabushiki Kaisha Also Honda Motor Co.

Class 13 - Firearms, Explosives and Projectiles

This class includes Firearms; ammunition and projectiles; explosives; fireworks.

Class 14 - Precious Metal ware, Jewellery, Precious Stones

This class includes jewellery, precious stones, hierological and chronometric instruments, jewellery, precious stones.

Class 15 - Musical instruments and supplies

This class includes musical Instruments and supplies.

Class 16 – Paper, Stationary items

This class includes playing cards, printing blocks, paper, cardboard, bookbinding material, photographs, stationery.

Class 17 - Rubber, Asbestos, Plastic Items

This class includes packing, stopping and insulating materials, flexible pipes, gutta-percha, gum.

Class 18 - Leather and Substitute Goods

This class includes parasol, walking sticks, whips, harness, saddlery, leather and imitations of leather.

For example – Hidesign by Hidesign India Private Limited

Class 19 - Construction Materials

This class includes building materials, rigid pipes for building (non-metallic), pitch and bitumen, asphalt.

For example – Ambuja Cement by Gujarat Ambuja Cements Limited.

Class 20 - Furniture, Mirrors

This class includes furniture, mirrors, picture frames; goods made of ivory, whalebone, shell, amber.

For example – IKEA by M/s.inter Ikea Systems Bv.

Class 21 - Crockery, Brushes, Cleaning Implements

This class includes household or kitchen utensils, containers, combs, sponges, glassware, porcelain, earthenware.

For example – Hawkins by Pressure Cookers & Appliances Limited

Class 22 - Cordage, Ropes, Nets

This class includes ropes, string, nets, tents, awnings, tarpaulins, sails, sacks, bags, raw fibrous textile materials

Class 23 – Yarns, Thread

This class includes yarns and threads, for textile use.

Class 24 - Fabrics, Blankets, Covers, Textile

This class includes textiles and textile goods, bed and table covers.

For example – Bombay Dyeing by The Bombay Dyeing & Manufacturing Co.

Class 25 - Clothing, Footwear and Headgear

This class includes clothing, footwear, and headgear.

For example – Vero Moda by Aktieselskabet Af

Class 26 - Sewing Notions, Fancy Goods

This class includes lace, embroidery, ribbons, braid, buttons, hooks and eyes, pins and needles, artificial flowers.

Class 27 - Carpets, Wall and Floor Coverings

This class includes carpets, rugs, mats, matting, and other materials for covering existing floors; wall hangings (non-textile)

Class 28 - Games, Toys, Sports Equipment

This class includes games, playthings, gymnastic, sporting articles, decorations for Christmas trees.

Class 29 - Dairy, Processed & Preserved Foods

This class includes meat, fish, poultry, meat extracts, preserved, frozen, dried and cooked fruits and vegetables.

Class 30 ­­- Spices, Bakery Goods, Confectionery

This class includes coffee, tea, cocoa, sugar, rice, tapioca, sago, artificial coffee, flour, preparations made from cereals.

Class 31 – Fresh Fruit & Vegetables, Live Animals

This class includes agricultural, horticultural, forestry products, grains, fresh fruits and vegetables, seeds, natural plants

Class 32 - Beer, Syrups, Soft Drinks, Carbonated Waters

This class includes beers; mineral and aerated waters, other non-alcoholic drinks, syrups, fruit juices.

Class 33 - Wines, Spirits, Liquors

This class includes all alcoholic beverages (except beers)

Class 34 - Tobacco, Smokers Requisites & Matches

This class includes tobacco; smokers' articles, matches

Class 35 - Advertising, Business Consulting, Office functions

This class includes advertising; business management, business administration, office functions

Class 36 – Insurance / Financial / Real Estate affairs

This class includes Insurance, financial affairs, monetary affairs, real estate affairs. 

For example - LIC by Life Insurance Corporation Of India. 

Class 37 – Construction, Repair, Cleaning (Services)

This class includes building construction, repair, and installation services

Class 38 – Communications & Telecom Services

This class includes services allowing at least one person to communicate with another by a sensory means.

For example - Airtel by Bharti Airtel Limited. 

Class 39 – Transport, Utilities, Storage & Warehousing

This class transport, packaging and storage of goods, travel arrangement

Class 40 – Materials Treatment, Working

This class includes treatment of materials related services.

Class 41 – Education and Entertainment

This class includes education, providing of training; entertainment, sporting and cultural activities.

Class 42 – Scientific and Technological Services

This class includes scientific and technological services, research and design, development of computer hardware and software.

Class 43 – Services for providing Restaurant Services

This class includes services for providing food and drink, temporary accommodation.

Class 44 – Medical services; veterinary services.

This class includes medical services, veterinary services, hygienic and beauty care for human beings or animals.

Class 45 – Legal / Security / Personal/ Professional Services

This class includes Legal services, security services for the protection of property and individuals.
